HAP adheres to
a very strict NO SPAM Policy.
All PAID users must agree to our Terms of Service
prior to becoming a HAP user. This document
clearly outlines and states our No SPAM Policy. If any of our
PAID users are reported for SPAM, the spam report will
be IMMEDIATELY investigated.
What is Spamming?
An
email is SPAM if it has been sent to an email
address that was not
requested from you. You must not send Spam via our service or
send Spam that in any way implicates our services by including
the hapitravellounge.com or domains
or any other web site associate with HAP.
This includes mentioning a HAP email address or URL in
any bulk email message or sending a message to an email address that was not
requested from
you. You must not send Spam via our service or
send Spam using any other service that in any way implicates our
system by including
the domains
or any other web site associate with HAP. This includes mentioning a HAP email address or URL
in any bulk email message using our service or any other bulk
mailing vendor.
Spamming consists of
sending unsolicited email messages to any recipient with whom
you do not have a personal, professional or business
relationship. It also consists of, but is not limited to:
- Non-Computer Related
Spamming Activities. The distribution of printed materials
on private property or where otherwise prohibited violates
our No Spam Policy.
- Chat Room Solicitations.
Solicitations posted in chat rooms or by use of instant
messaging systems.
- Usenet and Message Board
Spamming. These are messages that are sent or posted and
are misleading to potential referrals and are unrelated to
the topic of discussion.
- Hiring a
company that is mailing out to a list of people with your
opportunity that did not specifically request to receive
your information beforehand is considered Spam.
- Buying
a list of emails from a third party and individually or
bulk emailing them is considered Spam.
- Buying
a list of emails from a HAP non approved third party
lead vendor and individually or
bulk emailing them is considered Spam.
There are
certain cases when the use of a list obtained from an approved
HAP third
party lead vendor may be acceptable. In order for a mailing to a
third party list to be acceptable under our unsolicited email
policies, the following rules must be adhered to:
- The
email addresses obtained by the third party must be
strictly opt-in, and follow all of our policies regarding
opt-in email list collection, including ip address and
time/date stamp on each lead.
- The
third party assembling the email list must make a clear
disclosure stating that recipients' addresses ARE provided
to others.
- The
third party must be able to provide documentation
regarding the validity of the addresses in case of an
unsolicited email complaint.
- Any
messages sent to addresses obtained from a third party
must contain information disclosing the source of the
addresses. IF A THIRD PARTY PROHIBITS SUCH DISCLOSURE,
THEIR LIST MAY NOT BE USED IN OUR SYSTEM.
- The
content of messages sent to addresses from a third party
list must be consistent with the disclosure made to the
recipients upon initial provision of the email address.
- All leads must have opted in no more than 60 days prior to you
sending them email through our system.
We feel there is NO EXCUSE FOR SPAM!
Spamming is a serious problem, costing all Internet users a
great deal of time and money! HAP will not allow the actions
of a spammer to compromise those of our compliant good faith
PAID users.
There are too many EFFECTIVE advertising mediums available to
promote our HAP service within or outside of our
actual service.
We will absolutely
and positively NOT
tolerate Spam at HAP!
We reserve the right to
determine what violates our No SPAM Policy.
If after
investigation of a Spam complaint originated from your system,
we determine that you have violated our Spam Policy, you will:
- Have your backoffice
account, hapitravellounge.com or web site(s) immediately terminated without
a refund of any kind.
- Forfeit use of all
HAP services.
- Be banned from establishing
a future HAP account
- Face a possible fine of $500.00, not including a possible service interruption fine
as stated below.
- Be reported to your Internet
Service Provider.
- Be reported to other proper
authorities to take action against you.
Should HAP's service be interrupted due to spamming by
a PAID user, the user will be charged and billed
$500.00 USD per hour until service
is restored. USER will be subject to legal action if a
violation of the HAP Spam Policy should occur.
If you believe that you have
been "Spammed" by one of our users, please
Contact Us immediately. In order to file a formal Spam
Complaint with our company, you will be required to submit a
copy of the original email received, complete with headers
intact.
